TERMS AND CONDITIONS OF DISTRIBUTION JET-UNIT INC.

General

These Terms and Conditions (the "Terms and Conditions"), including the Delivery Policy, the In-Store Pickup Policy, the Return, Damages and Exchange Policy, and the Privacy Policy, where applicable, constitute the entire agreement between Jet-Unit Distributions Inc. also doing business as Canada Pontoon and Canada RV ("Jet-Unit") and you, the user of the Website (the "Agreement"), with respect to the terms and conditions of use of the www.jet-unit.com, www.canadapontoon.com and www.canadarv.com websites (collectively the "Website"). This Agreement is for an indefinite period of time and is effective upon your access to the Website.

By using the Website, you acknowledge and agree to all of the Terms and Conditions of use of the Website which are replicate in these Terms and Conditions. These Terms and Conditions may be changed by Jet-Unit at its sole discretion and without notice.

Jet-Unit makes no warranty as to the availability of the Website and reserves the right to terminate the Website or to change, suspend or discontinue any aspect of the Website at any time in its sole discretion and without notice. Jet-Unit also reserves the right to deny access to the Website to any user, without notice and without providing any reason. The Website is provided on an "as is" and "as available" basis and may not be modified by you or any other user.

Limitation of use

Only persons who have reached the age of majority and who are entitled to enter into contracts under the applicable laws of their jurisdiction of residence may use Jet-Unit's online service.

You should not:

  • include content from the Website in a product or service that you create or distribute;
  • copy content from the Website to your or a third party's website;
  • use the Website in any manner that could damage, disable, overburden, impair, interfere with or otherwise abuse the Website, computer resources, accounts, servers or networks
  • use the Website or its content in a manner that violates the legal rights of any third party (including privacy rights, copyright, moral rights, and other intellectual property rights), is unlawful, violates the rights of Jet-Unit, its agents, suppliers, or subcontractors, is prohibited under these Terms and Conditions, or is otherwise objectionable or disrespectful of the rights and interests of others.
  • use the Website or its content to collect or use personal information about other users (including their e-mail addresses) without their prior consent.
  • use the Website for commercial purposes or in connection with commercial activities, except to enter into an agreement with Jet-Unit.

Prices and payment

All prices published by Jet-Unit on the Website are in Canadian dollars and are subject to change at any time without notice. Prices posted exclude applicable taxes and delivery charges, which will be calculated at the time of ordering. Applicable taxes are calculated according to the address to which your order is shipped, or according to applicable laws and regulations.

For all deliveries outside of Canada, any customs fees and local taxes are the responsibility of the recipient. Refunds of items due to availability are also made in Canadian dollars. Please note that the exchange rates applied are those in effect on the day of the order or when the refund is issued. Jet-Unit will refund the same amount in Canadian dollars for the sold out or returned item, but cannot be held responsible for any difference in currency due to the exchange rate applied by the customer's bank.

The price of the product is as posted on the Website, except for errors, for which Jet-Unit cannot be held responsible. If an error is discovered in the price of the product you ordered, Jet-Unit will notify you as soon as possible and give you the option of reconfirming the order at the appropriate price, or canceling it, in which case you will receive a full refund.

All product, including custom-made or personalized product according to your specifications, is payable in full at the time of placing the online order, including applicable sales taxes and shipping charges.

Warranty and return of goods

In the event of a defective, incomplete, or non-conforming product, it is your responsibility to email a claim to Jet-Unit's customer service department within fourteen (14) days of receipt of the product at the following address: info@canadapontoon.com.

Jet-Unit will only recognize defects related to technical imperfections or failures of the delivered product. Jet-Unit warrants that the claim will be investigated with the utmost care and that the response provided will take into account the customer's interests, with the final decision remaining at all times at the sole discretion of Jet-Unit.

In the event that the claim is accepted, Jet-Unit reserves the right to make a replacement delivery or refund of the affected product, all in accordance with the Return Policy.

Subject to the foregoing, custom-made or personalized product is not subject to the Return Policy.

Online account and password

It is your sole responsibility to ensure that your account access information (username and password) is kept confidential and is not disclosed to anyone or that you do not allow anyone else to use it. It is important that you choose a password that is confidential and difficult to discover, change it regularly, and log out of each session ("Log Out") after using Jet-Unit's online account service. You are solely responsible for the use and misuse of your username and password, and for the security of your password.

Copyright Policy

By uploading files to the Website, including photos, you confirm that you own all right, title and interest in and to all copyrights in such files, and that such files do not infringe or violate the moral rights of others, including the right to privacy. You shall be liable for any infringement and/or damages arising from uploading the files, all to the fullest exclusion of Jet-Unit's liability.

File content policy

You are prohibited from uploading to the Website any files, including photos, containing material that may be deemed illegal, threatening, abusive, defamatory, obscene, pornographic or offensive to any community. The content of the files you submit is governed by the laws of Canada including laws prohibiting copyright infringement, obscenity, pornography, child pornography or child abuse.

We make no commitment to monitor or audit the use of the Website, although we reserve the right to do so in our sole discretion. We will take appropriate action against you if we become aware of any inappropriate use of the Website by you. You shall be liable for any damages suffered by Jet-Unit or third parties as a result of any violation(s) of this section, all to the fullest exclusion of Jet-Unit's liability.

Privacy

By using the Website, you acknowledge that you have read Jet-Unit's Privacy Policy, and you agree that the policy is reasonable. You consent to the use of your personal information by Jet-Unit or third parties in accordance with the Terms and Conditions and for the purposes set forth in this policy.

Non-responsibility

To the extent permitted by law, Jet-Unit, its officers, directors, employees, representatives and agents (collectively, the "Jet-Unit Representatives") make no representations or warranties with respect to the Website and its content, including (i) any warranty that the Website or its content will meet your requirements or will be compatible with your computer or equipment requirements, (ii) any warranty that the Website or its content is accurate, valid, reliable, authentic, current or complete or (iii) any warranty that the Website will continue to operate or be operated without interruption or error.

Jet-Unit Representatives make no representation or warranty that the Website or its content is appropriate or available for use from any location. Access to the Website from any country where its contents are illegal is prohibited, and those who choose to access the Website from outside Canada do so on their own initiative and are responsible for compliance with local laws.

Product advertised on the Website may not be available in your area, and Jet-Unit makes no representation as to the availability of the product or the supply delays of such products.

You acknowledge that your use of the Website is at your own risk, and that Jet-Unit shall not be liable for any damages or injury you may incur in accessing and/or using the Website, including the presence of viruses or any other destructive elements that may have infected the Website, nor for any inconvenience, delay or inability to access the Website or its contents.

Finally, Jet-Unit is not responsible for any damage, claim or injury of any kind related to the misuse of the product, modification of the product, improper selection of product or misappropriation of the product.

Copyrights and trademarks

All information, content, software, trademarks and materials appearing on, contained in or offered through the Jet-Unit online service are the exclusive property of Jet-Unit and are protected by trademarks, copyrights and other laws of Canada. You may not use, copy, distribute or reproduce any or all of this information, content, software, trademarks without the prior written consent of Jet-Unit.

Amendment to the Convention

Jet-Unit may amend the Agreement at its sole discretion, in whole or in part, unilaterally, without any liability towards you or any other person and without prior notice to you or any other person. Any new version of the Agreement will be posted on this page. Therefore, when using the Website, it is your sole responsibility to check the date and version of the Agreement and, if applicable, to review any changes made since the last version.

Jurisdiction and applicable laws

These Terms and Conditions and the content of the Website are governed by the laws of the province of Quebec, and any dispute arising therefrom shall be submitted to a court of competent jurisdiction in Quebec.

In the event that any particular provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, such invalidity shall not in any way affect the intent or scope of these Terms and Conditions, all other provisions shall otherwise remain in full force and effect.

Jet-Unit's failure to exercise any of its rights shall in no way be construed as a waiver of any future exercise of that right or any other right under these provisions, which shall otherwise remain in full force and effect.

Acceptance of this agreement

Each time you use the Canada Pontoon online service, you attest that you agree and that all the persons you could represent agrees to be bound by this agreement and declare and warrant that you are entitled to accept this agreement in your name and in the name of the persons you could represent. If you do not accept all the clauses of this agreement or if you are not entitled to accept this agreement, you are not allowed to use the Canada Pontoon online service. A contract is concluded between the client and Canada Pontoon upon the payment and sending of the order confirmation email by the Canada Pontoon online service. This contract is the confirmation of your acceptance of the Canada Pontoon online service terms and conditions agreement.

Limitation of use

Only persons over the age of majority and who are entitled to contract under the applicable laws of their home jurisdiction may use the Canada Pontoon online service.

Copyright policy

By uploading files to the Canada Pontoon online service website, you confirm that you have all the rights, titles and interests relative to all copyrights of photos and that they do not violate or infringe moral rights of others, including the right to privacy.

Photos content policy

It is forbidden to upload to the Canada Pontoon online service website any file containing material that can be considered illegal, threatening, abusive, defamatory, obscene, pornographic or offensive to any community. The content of photos you submit is governed by the laws in force in Canada, including laws prohibiting the infringement of copyright, obscenity, pornography, child pornography or child abuse. We take no commitment into monitoring or controling the use of this online service, although we reserve the right to do it at our entire discretion. We will take steps against you if we find inappropriate use of the Canada Pontoon online service on your part.

Collection and use of your personal information

Canada Pontoon will only use your personal information to communicate with you, respond to your requests, facilitate and enhance your use of the online service, process transactions with you and any other activity permitted by law. Additionally, Canada Pontoon can keep a record of all correspondence with you.

Protecting your information

In order to protect the confidentiality of your personal information, Canada Pontoon online service uses up to date protection software. However, due to the nature of the Internet, it is impossible to eliminate all risks of a security and privacy violation. As a result, the Canada Pontoon online service cannot guarantee that your personal information will not be disclosed in an unlawful manner and without his consent.

Your password

For security reasons, your password must remain confidential and you must never reveal it to anyone or allow anyone to use it. It is important that you choose a password that is confidential and difficult to discover. Change it regularly and close each session (Log Out) after using the service. You are solely responsible for the use and misuse of your username (email address) and password. The security and privacy conferred by the password is not perfect and can be bypassed. You use your password at your own risks. It is your responsibility to keep it safe and confidential.

Withdrawal clause

Canada Pontoon only supplies products that are manufactured with your files according to your specifications (customer specifications) and are clearly tailored to your specific needs. There is therefore no legal right of withdrawal for these products.

Disclaimer

By using the Canada Pontoon online service, you agree that any loss or damage which you may suffer by using the Canada Pontoon online service or from all products purchased by such a use does not give you the right to any compensation or reimbursement. The services we provide are without warranty of responsibility of any kind, either explicit, implied, legal or any other. Production times indicated for each product are for information purposes only and do not engage in any way the responsibility of Canada Pontoon. Canada Pontoon is not responsible for any loss or damage suffered by you or any other person resulting from a delay or failure to perform the job caused or not by circumstances beyond its control.

Products warranty

Canada Pontoon manufactures high quality products, all of which are subject to rigorous quality control. However, if a product is delivered faulty, incomplete or non-compliant, you must quickly address a reclamation by email to our customer service within 14 days of reception of the goods at: info@canadapontoon.com.Canada Pontoon can only recognize defects if they refer to technical imperfections of the delivered goods. Regarding a potential defect of the delivered goods caused by Canada Pontoon, no return will be accepted without the prior approval from our customer service. We guarantee that the reclamation will be examined with the greatest care and that a response taking into account the interests of the client will be made. Following the acceptance of the reclamation, Canada Pontoon reserves the right to make a replacement delivery or a refund of the ordered goods.

Our copyrights and trademarks

All information, content, software, trademarks and material appearing, contained or offered by the Canada Pontoon online service is the exclusive property of Canada Pontoon and is protected by trademark, copyright and other laws in effect in Canada. You cannot use, copy, distribute or reproduce a part of or all of this information, content, software and trademarks without the prior written consent of Canada Pontoon.

Modification

To reflect changes made to the Canada Pontoon online service, technological and legal evolution, Canada Pontoon may change this agreement at its discretion from time to time without liability to you or any other person and without having to notify you or to notify any other person beforehand. Any newer version of this agreement will be posted on this page. Therefore, when you use the Canada Pontoon online service, you must check the date and the agreement’s version and review any changes made since the last release.

Termination of membership

We reserve the right to terminate your membership to the Canada Pontoon online service if you violate any of the clauses of this agreement.

Jurisdiction

These terms and conditions are governed by the laws of the Province of Quebec and the laws of Canada that are applicable. Any dispute concerning the validity, interpretation or execution of these conditions will be subject to the exclusive jurisdiction of the judicial district of Quebec, Canada.
